The Anti-Corruption Commission (ACC) is set to file cases against three National Board of Revenue (NBR) officials on charges of mishandling tax documents and facilitating evasion of more than Tk 146 crore.
Deputy Tax Commissioner of Tax Zone-5, Lincoln Roy, has been temporarily suspended and named as an accused in an ACC-approved case.
His suspension order, signed by NBR Chairman Md Abdur Rahman Khan on Thursday, stated that while working at the Withholding Tax Management Unit, Roy caused a revenue loss of Tk1,465,746,553 by issuing revised tax assessment orders for 2020-21 and 2021-22 fiscal years. Departmental proceedings have been initiated against him under Rule 12 (1) of the Government Servants (Discipline and Appeal) Rules, 2018.
Alongside Roy, the ACC also approved cases against former tax commissioner of Tax Zone-5, Abu Sayeed Md Mustaque, and additional tax commissioner Golam Kabir, for concealing documents and enabling the large-scale evasion. The lawsuits will be filed by ACC Assistant Director Minhaj Bin Islam.
The investigation revealed that Dhamsur Economic Zone Limited was liable to pay Tk146.57 crore in taxes for FY21 and FY22. However, the accused officials revised the assessments, reducing the liability to zero and Tk 1,000 respectively. The original files later went missing and were not recovered even during an ACC enforcement raid.
An ACC raid on 10 July at the Tax Zone-5 office confirmed that the files had been deliberately disappeared. Investigators also found anomalies in the tax assessment register, where two companies were granted unusual exemptions in FY23.
The audit confirmed that the actual tax liabilities should have been Tk 72.96 crore for FY21 and Tk 73.61 crore for FY22, totalling Tk 146.57 crore. Instead, the revised orders reduced them to zero and Tk1,299.
Earlier, on 17 April, the NBR forced Mustaque and Kabir into retirement over allegations of irregularities and corruption. With Roy’s suspension now in place, all three officials face both departmental and ACC action.
