The hearing on three appeals filed by 1,137 candidates deprived of recruitment in the 27th BCS has concluded. The Appellate Division will deliver its verdict tomorrow, Thursday. After the hearing, the five-member Appellate Division, led by Chief Justice Syed Refat Ahmed, set the date for the judgment today, Wednesday.
In 2010, the Appellate Division upheld the High Court’s decision declaring the cancellation of the first-ever oral exam in the 27th BCS valid. Following that ruling, 140 candidates filed three separate appeals last year on behalf of 1,137 candidates seeking a review of the decision. In response to the appeals, the Appellate Division granted leave to appeal and issued an order.
During the caretaker government’s tenure, the first oral exam in the 27th BCS was canceled, a decision was made to hold a second oral exam. However, the candidates deprived of recruitment challenged the decision to conduct a second oral exam by filing a writ petition.
In 2008, a High Court bench declared the decision to cancel the first oral exam valid, but another High Court bench declared the second oral exam invalid in 2009.
In response to the first ruling, 25 candidates deprived of recruitment filed two leave-to-appeal petitions in the Appellate Division. On the other hand, the government filed three leave-to-appeal petitions against the second ruling. After considering some observations, the Appellate Division settled the government’s leave-to-appeal petitions and delivered its judgment in 2010. In the Appellate Division’s ruling, the High Court’s decision declaring the cancellation of the first-ever oral exam in the 27th BCS valid was upheld.
Subsequently, following a review petition of the Appellate Division’s ruling, leave-to-appeal was granted, three separate appeals were filed on behalf of 1,137 deprived candidates. Senior lawyer Salah Uddin Dolon represented the appellants, while Additional Attorney General Anik Ar Haque appeared for the state. Additionally, lawyer Mohammad Khalekuzzaman Bhuiyan represented the PSC (Public Service Commission) during the hearing.
