Cases only if hate speech includes a call for violence : Fayez Taiyab

Fayez Ahmad Taiyab, Special Assistant to the Chief Adviser on Posts, Telecommunications and Information Technology, said the new Cyber Security Ordinance 2025 does not allow any case to be filed on allegations of defamation or insult.

He said hate speech will amount to a criminal offence only when it incites violence or calls for violence.

He confirmed the information in a post on the social media platform Facebook late Thursday night.

Taiyab said, “No provision in the new Cyber Security Ordinance 2025 allows cases on defamation. Hate speech creates grounds for a case only if it triggers violence or calls for violence — not before that.”

He said the ordinance leaves no scope to misuse cyber laws in the name of defamation, character assassination, derogatory remarks or insult. “We urge all sides to remain cautious so that no one files defamation cases citing the cyber ordinance or misuses the law,” he added.

Earlier on 22 May this year, the government issued the Cyber Security Ordinance to prevent cybercrime and ensure safety online. It was later published as a gazette.

According to the ordinance, the previous Cyber Security Act 2023 lacked necessary safeguards for citizens, allowing misuse and persecution and undermining freedom of expression and other civil rights.
