Court to decide fate of Maradona trial after judge steps down

An Argentine court will decide Thursday whether to restart the trial against Diego Maradona’s medical team after a presiding judge stepped down for participating in a documentary about the case, sparking allegations of judicial misconduct.

The future of the high-profile trial involving the late football legend Diego Maradona’s medical staff hangs in the balance as an Argentine court prepares to issue a crucial ruling on Thursday. The proceedings, which began in March, could be scrapped and restarted following the withdrawal of Judge Julieta Makintach.

Makintach recused herself earlier this week after her involvement in interviews for a miniseries about the ongoing trial became public. Her actions have drawn sharp criticism from prosecutors, plaintiffs, and several defense attorneys, who argue that judicial neutrality has been compromised.

The group is calling for the formation of a new judicial panel and the initiation of a fresh trial. If granted, the move would annul 20 hearings and the testimonies of over 40 witnesses already presented.

The trial centers on the conduct of seven medical professionals charged with criminal negligence in managing Maradona’s post-surgery care at home. The football icon died in November 2020 at the age of 60 while recovering from brain surgery. The accused could face prison sentences ranging from 8 to 25 years if found guilty of “homicide with possible intent,” a charge applied when reckless actions are taken despite known risks of death.

Prosecutor Patricio Ferrari acknowledged the potential delay but stressed the importance of judicial fairness. “Sometimes you have to take a step back to be able to take two forward,” he told local radio on Wednesday, expressing hope that the trial could restart later this year.

The two remaining judges are expected to deliver their decision during Thursday’s scheduled hearing, which could reshape the legal path forward in one of Argentina’s most closely watched cases.
