EC proposes disqualification for fugitives

The Election Commission (EC) on Wednesday proposed to add a provision to the existing law disqualifying an accused fugitive from running for the national parliamentary elections.

The EC proposed to bring several other amendments to the laws related to the parliamentary elections in the Representation of People’s Order (RPO), Election Commissioner Abu Fazal Md Sanaullah told reporters on Wednesday.

According to Sanaullah, the EC sent the proposal to the law ministry on Tuesday (2 Sept) and the ministry will do voting on the EC proposal and then it will be taken to the Advisory Council.

If approved by the Advisory Council, the amendment will be added to the law through the issuance of a presidential ordinance, EC officials said.

The Electoral System Reform Commission had recommended adding a provision to disqualify fugitives from contesting elections.

However, at the time, the Election Commission (EC) disagreed, stating that such a provision could be misused and required political consensus.

When asked why the EC has now accepted the proposal despite its earlier opposition, Sanaullah explained that the EC held discussions with the National Consensus Commission on the matter.

He said the EC was satisfied with the discussions and concluded that including such a provision would be beneficial.

“If it is misused in the future, the law can be amended again if necessary,” he added.

The Reform Commission had also proposed that anyone accused by the International Crimes Tribunal should be declared ineligible to contest elections.

However, this provision was not included in the EC’s final proposal.
